These Terms of Service ("Terms") govern your use of Badger ("the app", "we", "us"). By installing or using the app you agree to these Terms.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your personal use.
2. Health disclaimer
Badger is a workout tracking tool, not medical advice. Consult a qualified health professional before starting any exercise program, changing your program, or if you experience pain or injury. You assume full responsibility for decisions you make while using the app.
3. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law.
- Use the app to violate any applicable law or regulation.
- Interfere with or disrupt the app's normal operation.
4. "As is" - no warranties
The app is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any defect will be corrected.
5. Limitation of liability
To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability to you for any claim arising out of or relating to these Terms or the app is limited to the amount you have paid us in the twelve months preceding the claim, or USD $10, whichever is greater.
6. Data
Your workout data is stored locally on your device. See the Privacy Policy for details. We are not responsible for data loss caused by device failure, uninstallation, or failure to maintain backups.
7. Termination
You may stop using the app at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms or use the app in a manner that creates risk for us or other users.
8. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Exclusive jurisdiction for disputes lies with the state and federal courts located in California.
9. Changes
We may update these Terms from time to time. When we do, we'll update the Last updated date at the top. Continued use after an update constitutes acceptance.
